IMPORTANT: PLEASE READ THIS AGREEMENT CAREFULLY BEFORE USING THIS SOFTWARE. BY INSTALLING, COPYING, OR OTHERWISE USING THIS SOFTWARE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT AGREE, DO NOT USE THIS SOFTWARE.

IN PARTICULAR, YOUR ATTENTION IS DRAWN TO SECTION 7 (ENGINEERING DISCLAIMER & PROFESSIONAL RESPONSIBILITY), SECTION 8 (ASSUMPTION OF RISK & PROHIBITED HIGH-RISK USE), SECTION 9 (INDEMNIFICATION), SECTION 10 (DISCLAIMER OF WARRANTIES) AND SECTION 11 (LIMITATION OF LIABILITY).

1. DEFINITIONS

"Software" means the SimulATe Cable Containment & Support Calculation application, including all associated files, libraries, databases, documentation, report templates, and updates.

"Author" means Akin Turcan / SimulATe Engineering Software, the sole developer and copyright holder.

"User" or "You" means the individual or entity that has obtained a license to use the Software. You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to enter into this Agreement.

"License" means the right to use the Software as granted under this Agreement.

"License Key" means the unique activation code provided to You upon purchase.

"Computer ID" means the hardware fingerprint generated by the Software to identify the licensed device.

"Output" means any result produced by or with the Software, including but not limited to calculation results, sizing recommendations, utilization ratios, pass/fail verdicts, warnings, 2D/3D drawings and visualizations, diagrams, bills of material, PDF/DXF/Excel reports, and responses of the built-in AI Copilot assistant.

"Third-Party Data" means technical data referenced or embedded in the Software that originates from third parties, including manufacturer catalogs (cables, trays, conduits, supports, anchors), European Technical Assessments (ETA), and tables or formulas published in international or national standards.

2. LICENSE TIERS & BILLING

The Software is offered in the following tiers and billing options:

2.1 FREE TRIAL

- Free evaluation, no payment required

- Full access to all PRO features during the trial period

- Limited to FOURTEEN (14) days from first launch OR THIRTY (30) calculations in total, whichever occurs first

- Bound to a single computer; the trial clock is tamper-protected and cannot be extended by changing the system time or reinstalling

- When the trial ends, calculations are disabled until a license is activated; Your project files remain accessible and intact

- Intended for evaluation purposes only; not for commercial use

2.2 STANDARD

Single-user license with full cable-sizing capabilities.

Features included:

- All cable sizing calculation modules (IEC 60364-5-52, BS 7671, VDE 0100, NEC, AREI/RGIE), including tray, ladder, conduit, duct bank (buried D1/D2) and signal-tray configurations

- Grouping, ambient/ground temperature, soil resistivity and installation-method correction factors

- Voltage drop, conduit fill and bend radius checks

- Support structural analysis — all nine (9) support types (rod suspension, trapeze, wall arm, bracket, binrack, beam clamp, sway brace, spring hanger and related configurations) with EN 1993-1-1 / EN 61537 based member checks, M/V/deflection diagrams, load combinations and concrete anchor design checks (EN 1992-4 method with ETA-based anchor data)

- Fire condition check (EN 1993-1-2 steel reduction factors, DIN 4102-12 span limits)

- Batch calculation and multi-section batch exports

- 2D cross-section drawings, 2D static-analysis sheets and project reports (PDF/DXF/Excel export; PRO-only report chapters excluded)

- Digital signature block, audit trail and report QR/online sharing

- AI Copilot engineering assistant (fully local, see Section 14)

- All cable, tray, conduit and manufacturer databases

- Multi-language interface (24 languages)

- Technical support via email

- Activation on ONE (1) computer

Billing options:

- MONTHLY subscription — billed per calendar month, cancel anytime

- ANNUAL subscription — billed per year (discounted vs monthly)

- PERPETUAL (one-time) — pay once, use forever; includes 1 year of free updates from date of purchase

2.3 PRO

Single-user license with all features.

All STANDARD features plus:

- Cable pulling analysis (IEEE 1185)

- Seismic design (ASCE 7-16/7-22 component force, EN 1998-1 / Eurocode 8 spectra)

- Thermal expansion analysis

- 3D Pro visualization with static-analysis overlays

- Route Designer with DXF import/export

- PRO report chapters in generated PDFs (3D model view, seismic, thermal expansion, cable pulling)

- Activation on up to TWO (2) computers

- Priority technical support (48h response)

Billing options:

- MONTHLY subscription — billed per calendar month, cancel anytime

- ANNUAL subscription — billed per year (discounted vs monthly)

- PERPETUAL (one-time) — pay once, use forever; includes 2 years of free updates from date of purchase

2.4 ENTERPRISE / MULTI-SEAT

For companies requiring multiple users:

- TEAM (3-10 seats) — discounted per-seat pricing

- CORPORATE (11-50 seats) — volume discount + dedicated account manager

- ENTERPRISE (50+ seats) — custom pricing, site license available

- FLOATING LICENSE — concurrent-use licensing (e.g., 20 seats shared among 50 engineers, max 20 active at any time)

Enterprise features:

- Centralized license management portal

- Invoice billing (NET 30/60)

- Custom onboarding and training

- Service Level Agreement (SLA) option

- Custom database integration

2.5 SUBSCRIPTION TERMS

a) MONTHLY subscriptions renew automatically each calendar month. You may cancel at any time; cancellation takes effect at the end of the current billing period. No partial-month refunds.

b) ANNUAL subscriptions renew automatically each year. You may cancel at least 30 days before the renewal date. If cancelled, You retain access until the end of the paid period.

c) AUTO-RENEWAL: By subscribing, You authorize recurring charges to Your payment method. You will be notified at least 14 days before each renewal. You may disable auto-renewal at any time through Your account or by contacting support.

d) PRICE CHANGES: Subscription prices may change. You will be notified at least 30 days before any price increase takes effect. If You do not agree to the new price, You may cancel before the next renewal.

e) PERPETUAL licenses do NOT auto-renew. After the included update period expires, You may continue using Your current version indefinitely. Access to newer versions requires a renewal or upgrade purchase.

f) EXPIRED SUBSCRIPTIONS: When a subscription expires:

- The Software locks calculations until the license is renewed

- All Your project files remain accessible and intact

- You may re-subscribe at any time to restore full access

3. GRANT OF LICENSE

Subject to the terms of this Agreement, the Author grants You a limited, non-exclusive, non-transferable license to:

3.1 INDIVIDUAL LICENSE (Standard / Pro)

a) Install and activate the Software on the number of computers or devices Your tier permits — ONE (1) computer for STANDARD, up to TWO (2) computers for PRO (e.g., one office desktop and one laptop) — that You personally own or control, provided that the Software is not used simultaneously on more than one device at the same time;

b) Use the Software solely for its intended purpose: engineering cable containment and support system calculations;

c) Make one (1) backup copy of the Software for archival purposes only.

3.2 MULTI-SEAT LICENSE (Team / Corporate / Enterprise)

a) Install and use the Software on the number of devices corresponding to the number of seats purchased;

b) Each seat authorizes ONE (1) named user or ONE (1) concurrent user (depending on the license type: named-user or floating);

c) The license administrator may reassign seats to different users, but not more than once per calendar month per seat;

d) All seats must be of the same tier (Standard or Pro) and billing cycle (monthly or annual);

e) Multi-seat licenses include a centralized license management dashboard accessible to the designated administrator.

3.3 FLOATING LICENSE

a) A floating license allows a pool of users to share a limited number of concurrent seats. For example, a 10-seat floating license may be installed on 50 computers, but no more than 10 may be active simultaneously.

b) When a user closes the Software, the seat is released and becomes available for another user.

c) Floating licenses require an internet connection for seat management.

4. RESTRICTIONS

You may NOT:

a) Copy, reproduce, distribute, publish, or transmit the Software or any part thereof, except as expressly permitted in Section 3;

b) Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Software;

c) Remove, alter, or obscure any copyright notices, trademarks, or other proprietary rights notices contained in the Software;

d) Remove, alter, or obscure any engineering disclaimer, verification notice, or standards reference that the Software embeds in generated reports or drawings;

e) Rent, lease, lend, sell, sublicense, or otherwise transfer the Software or any rights therein to any third party without written consent;

f) Use the Software to develop a competing product or service, or extract its databases, correction-factor tables, or catalog data for use in any other product;

g) Use the Software in any manner that violates applicable laws;

h) Share, publish, or disclose Your license key or activation credentials to any third party (including colleagues within the same company — each user requires their own seat or license);

i) Attempt to circumvent, disable, or interfere with any security features, license verification, or copy protection mechanisms of the Software;

j) Use a single-user license for more users than the license permits;

k) Use the FREE TRIAL for any commercial or production work;

l) Continue using the Software after a subscription has expired (the Software will automatically lock calculations until renewal);

m) Use the calculation results from an expired or unlicensed copy of the Software in any engineering deliverable;

n) Represent any Output as having been produced, checked, certified, sealed, or approved by the Author or by SimulATe Engineering Software.

MULTI-SEAT RESTRICTIONS (Team / Corporate / Enterprise):

o) The license administrator may not exceed the purchased number of seats;

p) Seats may not be shared simultaneously by multiple users (named-user license) or exceed the concurrent limit (floating license);

q) The company may not split a multi-seat license across multiple legal entities without prior written consent from the Author.

5. INTELLECTUAL PROPERTY

The Software is protected by copyright laws, international treaties, and other intellectual property laws. The Author retains all right, title, and interest in and to the Software, including all copyrights, trade secrets, and other intellectual property rights.

This Agreement does not grant You any ownership interest in the Software.

Reports, drawings and other Output generated by You with a validly licensed copy of the Software may be used in Your own business and projects, subject to Sections 4(d), 4(m), 4(n) and 7 of this Agreement.

SimulATe(TM) is an unregistered trademark of Akin Turcan.

6. THIRD-PARTY TECHNICAL DATA & MANUFACTURER CATALOGS

a) The Software references Third-Party Data (cable dimensions and ratings, tray/ladder/conduit dimensions and load capacities, support and anchor characteristics, material specifications) sourced from publicly available manufacturer catalogs, European Technical Assessments (ETA), and international or national standards (IEC, BS, NEC, VDE, AREI/RGIE, ASCE, EN, DIN, IEEE). This data is used solely for engineering calculation purposes.

b) The Author does not claim ownership of factual technical data from third-party manufacturers or standards bodies. All manufacturer names, product names, and trademarks referenced within the Software belong to their respective owners and are used for identification purposes only. No manufacturer or standards body has endorsed, certified, sponsored, or reviewed the Software.

c) Third-Party Data embedded in the Software reflects the catalog editions, ETA versions, and standard editions available to the Author at the time the relevant database was compiled. Manufacturers revise catalogs, withdraw products, and reissue ETAs; standards bodies publish new editions, amendments, corrigenda, and national annexes. THE AUTHOR DOES NOT WARRANT THAT ANY EMBEDDED DATA IS CURRENT, COMPLETE, OR FREE OF TRANSCRIPTION ERRORS.

d) Before relying on any Output, You MUST verify all product data against the manufacturer's current official datasheet or catalog, and all anchor data against the current ETA and the anchor manufacturer's own design software and installation instructions.

e) Where the Software identifies the standard edition it implements (e.g., IEC 60364-5-52 Ed. 3.0:2009), You are responsible for confirming that this edition — and not a later edition, amendment, or deviating national annex/local code — applies to Your project and jurisdiction.

7. ENGINEERING DISCLAIMER & PROFESSIONAL RESPONSIBILITY

THIS IS THE MOST IMPORTANT SECTION — PLEASE READ CAREFULLY

THE SOFTWARE IS A COMPUTATIONAL ENGINEERING AID. IT IS NOT A SUBSTITUTE FOR PROFESSIONAL ENGINEERING JUDGMENT, DESIGN REVIEW, INDEPENDENT CALCULATION, OR REGULATORY COMPLIANCE.

7.1 NATURE OF THE OUTPUT

a) All Output is provided for PRELIMINARY DESIGN AND REFERENCE PURPOSES ONLY. Output is generated automatically by applying published formulas and tables to the input values YOU provide; it does not, and cannot, take into account actual site conditions, workmanship, installation quality, environmental factors, or project-specific circumstances not entered into the Software.

b) All Output MUST be independently verified, and where legally required approved, stamped, or sealed, by a qualified professional engineer licensed in the relevant jurisdiction BEFORE being used in any construction, installation, procurement, manufacturing, or safety-related application.

c) The Software's calculation algorithms have NOT been certified, audited, or approved by any professional engineering body, standards organization, notified body, or regulatory authority. Pass/fail verdicts, utilization colors, and warning messages generated by the Software are informational computations, not professional opinions.

d) Output is not a certified, sealed, or signed engineering document. The optional signature block and QR/timestamp features are graphical and cryptographic conveniences only; they do NOT constitute a qualified electronic signature within the meaning of Regulation (EU) No 910/2014 (eIDAS), a professional engineer's seal, or any form of professional certification by the Author.

e) The built-in AI Copilot assistant produces automated informational responses. Its answers may be incomplete or incorrect and must never be relied upon without independent verification by a qualified engineer.

7.2 YOUR RESPONSIBILITIES

The User bears SOLE responsibility for:

a) The accuracy, completeness, and suitability of ALL input data (loads, spans, cable data, dimensions, temperatures, soil parameters, seismic parameters, safety factors, and every other value entered or accepted as a default). Incorrect or incomplete inputs will produce incorrect Output;

b) Independently verifying all Output, including by manual calculation or by comparison with other established engineering tools;

c) Ensuring compliance with all applicable building codes, electrical codes, fire codes, seismic provisions, national annexes, local amendments, and safety standards in force at the project location;

d) Confirming that the standard editions implemented by the Software apply to the project (see Section 6(e));

e) Verifying all manufacturer and anchor data against current official sources (see Section 6(d)); in particular, final anchor selection and verification MUST be performed with the anchor manufacturer's current ETA and design software;

f) Obtaining all necessary engineering reviews, approvals, and permits;

g) Making all final engineering decisions, including the decision to use, adapt, or reject any Output.

7.3 NO PROFESSIONAL SERVICES RELATIONSHIP

a) The Author is a software publisher. The Author does NOT provide engineering, design, consulting, inspection, or other professional services through the Software, its documentation, its support channels, or its AI Copilot.

b) No engineer-client, advisor-client, fiduciary, or other professional relationship is created between You and the Author by Your purchase or use of the Software. The Author is not the engineer of record for any project, assumes no duty of care with respect to any project, and owes no obligations to any third party (including Your clients, contractors, or end users).

c) Technical support answers questions about OPERATING the Software; it does not review, validate, or approve Your designs or inputs.

7.4 PROFESSIONAL USER REPRESENTATION

By using the Software for any purpose other than evaluation, You represent and warrant that You are — or that all Output will be reviewed before use by — a person with the professional qualification, training, and experience necessary to understand, check, and take responsibility for the engineering calculations concerned.

8. ASSUMPTION OF RISK & PROHIBITED HIGH-RISK USE

a) ASSUMPTION OF RISK: You acknowledge that electrical installations and structural supports involve inherent risks (including fire, electric shock, structural failure, and personal injury) and that software-based calculations can never eliminate those risks. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU ASSUME ALL RISK ASSOCIATED WITH YOUR USE OF THE SOFTWARE AND OF ANY OUTPUT.

b) HIGH-RISK USE: The Software is not designed, tested, or licensed for use as the sole or primary design basis in environments requiring fail-safe performance, including without limitation: nuclear facilities, life-support or other critical medical systems, aircraft and air-traffic systems, railway signaling, weapons systems, or any application in which a calculation error could directly lead to death, personal injury, or severe physical or environmental damage ("High-Risk Use").

c) Any High-Risk Use is at Your sole risk and requires — in addition to the obligations in Section 7 — a complete independent design and verification process performed without reliance on the Software. The Author expressly disclaims any liability arising from High-Risk Use.

9. INDEMNIFICATION

To the maximum extent permitted by applicable law, You agree to indemnify, defend, and hold harmless the Author from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) brought by You or by any third party (including Your clients, employers, contractors, insurers, or persons suffering injury or damage) arising from or related to:

a) Your use of, or inability to use, the Software or any Output;

b) Any engineering, procurement, construction, or installation decision made in reliance on the Software or any Output;

c) Any breach by You of this Agreement, including of Your verification obligations under Sections 6 and 7;

d) Any inaccurate, incomplete, or unsuitable input data provided by You;

e) Any use of Output without the independent professional verification required by Section 7;

f) Any High-Risk Use as defined in Section 8;

g) Any injury to persons or damage to property connected with an installation calculated, drawn, or documented with the Software.

This Section 9 does not apply to the extent a claim results from the Author's fraud or intentional misconduct, and does not limit any mandatory statutory rights You hold as a consumer.

10. DISCLAIMER OF WARRANTIES

THE SOFTWARE, ALL THIRD-PARTY DATA, AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

THE AUTHOR DOES NOT WARRANT THAT:

a) The Software will meet Your specific requirements;

b) The Software will be uninterrupted, timely, secure, or error-free;

c) Any Output, verdict, warning, drawing, or database value will be accurate, complete, current, or reliable;

d) The Software implements any standard without error or implements the standard edition applicable to Your project;

e) Any errors in the Software will be corrected;

f) Any online service described in Section 15 will remain available.

NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY THE AUTHOR OR ITS SUPPORT CHANNELS SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THIS AGREEMENT.

Some jurisdictions do not allow the exclusion of implied warranties; in such jurisdictions the above exclusions apply to the maximum extent permitted, and any non-excludable warranty is limited in duration to the minimum period required by law.

11. LIMITATION OF LIABILITY

a) TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE AUTHOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: - Loss of profits, revenue, business, or goodwill; - Loss of, or damage to, data or project files; - Business interruption or delay; - Costs of re-design, re-work, demolition, replacement, or procurement of substitute goods or services; - Personal injury or property damage; - Claims of Your clients or any other third party; - Any damages arising from calculation errors, database errors, software defects, incorrect verdicts or warnings, or reliance on any Output; WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF THE AUTHOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

b) AGGREGATE CAP: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE AUTHOR'S TOTAL CUMULATIVE LIABILITY UNDER OR IN CONNECTION WITH THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR THE SOFTWARE LICENSE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM (OR, FOR A PERPETUAL LICENSE, THE AMOUNT PAID FOR THAT LICENSE).

c) SOLE REMEDY: Your sole and exclusive remedy for any defect in the Software is, at the Author's option: correction of the defect, replacement of the Software, or refund of the license fee paid for the affected period, whereupon this Agreement may be terminated.

d) EXCEPTIONS: Nothing in this Agreement excludes or limits the Author's liability for fraud, intentional misconduct, or any other liability that cannot be excluded or limited under applicable law (including, for consumers, mandatory consumer protection rights). The exclusions and limitations in this Section apply even if any limited remedy fails of its essential purpose.

e) TIME BAR: To the extent permitted by applicable law (and without limiting mandatory consumer rights), any claim arising out of or relating to this Agreement or the Software must be brought within ONE (1) YEAR after the date on which You became aware, or reasonably should have become aware, of the facts giving rise to the claim.

f) The limitations in this Section reflect the agreed allocation of risk between the parties: the license fee would be substantially higher if the Author accepted liability for engineering outcomes that only You — with knowledge of the project, the site, and the inputs — can control and verify.

12. UPDATES & SUPPORT

a) The Author may release updates, patches, or new versions of the Software at his sole discretion. There is no obligation to provide updates.

b) Updates released within Your included update period (1 year for STANDARD, 2 years for PRO) will be provided at no additional cost.

c) After the update period expires, You may continue using Your current version indefinitely, but access to newer versions requires a renewal.

d) Updates may change calculation behavior, for example when a standard edition is corrected or a database value is fixed. Release notes accompany each update; You are responsible for reviewing them and for re-checking any open project whose results may be affected.

e) The Author reserves the right to discontinue the Software at any time. Such discontinuation does not affect existing perpetual licenses.

13. REFUND & CANCELLATION POLICY

13.1 PERPETUAL LICENSES

a) You may request a full refund within fourteen (14) days of purchase, provided that You have not generated more than 10 calculation reports.

b) Refund requests must be sent to info@simulate-software.com.

c) Upon refund, Your license will be deactivated and You must delete all copies of the Software.

13.2 MONTHLY SUBSCRIPTIONS

a) You may cancel at any time. Cancellation takes effect at the end of the current billing period.

b) No partial-month refunds.

c) First month: full refund available within 14 days if unused.

13.3 ANNUAL SUBSCRIPTIONS

a) Full refund available within 30 days of purchase if You have not generated more than 10 calculation reports.

b) After 30 days, no refund; You retain access until the end of the paid annual period.

c) Cancel auto-renewal at least 30 days before the renewal date.

13.4 ENTERPRISE / MULTI-SEAT

a) Enterprise refund and cancellation terms are defined in the separate Enterprise License Agreement.

13.5 EU CONSUMER RIGHTS

In accordance with the EU Consumer Rights Directive (2011/83/EU), EU consumers acknowledge that by activating the license key, they consent to immediate access to digital content and understand that this may affect their statutory right of withdrawal. A 14-day withdrawal right is provided regardless (see 13.1/13.2/13.3 above).

14. PRIVACY & DATA PROTECTION

a) LOCAL PROCESSING BY DEFAULT: The Software performs all calculations locally on Your computer. Project files, calculation results, and engineering data are stored locally and are NOT transmitted to any external server, except in the specific, user-visible cases listed below and in Section 15.

b) AI COPILOT IS FULLY LOCAL: The built-in AI Copilot is a local rule-based calculation assistant. It does NOT connect to any external artificial-intelligence service; Your questions and chat history never leave Your computer (history is stored in a local file).

c) LICENSE VERIFICATION: When activating or verifying a license, the Software transmits to the Author's license server:

- Your license key

- A hardware-derived Computer ID (anonymous one-way hash — not reversible to identify hardware components)

- Software version number No project data is transmitted during license verification.

d) WEATHER DISPLAY (home screen): To show local weather and suggest an ambient temperature, the Software may contact two third-party services: an IP-based approximate-location service (ipwho.is) and a weather service (open-meteo.com). As with any internet request, Your IP address is technically visible to these services, which act as independent controllers under their own privacy policies. No project data, personal identifiers, or license information is sent. If no internet connection is available, the feature is silently skipped.

e) ONLINE SHARE (user-initiated only): If You explicitly use the "Share Online" feature, a snapshot of the selected calculation section is uploaded to the Author's share endpoint and a short link is returned. Shared snapshots expire and are automatically deleted after approximately 90 days. ANYONE WHO OBTAINS THE LINK CAN VIEW THE SHARED SNAPSHOT — do not share confidential project data. No project is ever uploaded automatically.

f) TIMESTAMP PROOF (user-initiated only): If You use the document timestamping feature, only a cryptographic hash (digest) of the document is transmitted to public OpenTimestamps calendar servers. The document itself never leaves Your computer, and the hash cannot be reversed to reconstruct its content.

g) CRASH REPORTS: The optional crash report feature allows You to voluntarily send error reports via email. Crash reports contain the error type and traceback, Software version, operating system, and tray configuration at the time of error (dimensions only, no personal data). No crash data is ever sent automatically.

h) GDPR COMPLIANCE (EU Users): As the data controller for license verification and the share endpoint, the Author (Akin Turcan, Belgium) informs EU users that:

- Legal basis for license verification: legitimate interest (license enforcement) per GDPR Article 6(1)(f)

- Legal basis for user-initiated features (share, timestamping, crash reports): performance of the contract / Your request, per GDPR Article 6(1)(b)

- Data retention: license verification data is retained for the duration of the license; shared snapshots for ~90 days

- Your rights under GDPR Articles 15-22: access, rectification, erasure, restriction, portability, and objection

- You may lodge a complaint with the Belgian Data Protection Authority (GBA/APD): www.dataprotectionauthority.be

i) NO TRACKING: The Software does not use cookies, analytics, telemetry, advertising identifiers, or any form of usage tracking.

15. ONLINE SERVICES

a) Certain features depend on online services: license activation and verification, floating-seat management, Online Share, weather display, and timestamp proof (together, "Online Services").

b) Online Services are provided on an "as available" basis. The Author may modify, suspend, or discontinue any Online Service (other than license verification for active licenses) at any time. Third-party services used by the Software (see Section 14(d) and 14(f)) are outside the Author's control.

c) The Software remains fully functional for local calculation work without an internet connection, except for features that inherently require connectivity (activation, floating seats, share, weather, timestamping).

16. TERMINATION

a) This Agreement is effective until terminated.

b) The Author may terminate this Agreement immediately if You breach any term of this Agreement.

c) Upon termination, You must immediately cease all use of the Software and destroy all copies in Your possession.

d) Sections 4, 5, 6, 7, 8, 9, 10, 11, 14, and 18 shall survive termination.

17. FORCE MAJEURE

The Author shall not be liable for any failure or delay in performance due to causes beyond reasonable control, including but not limited to: natural disasters, war, terrorism, pandemic, government actions, power failures, internet outages, or third-party service disruptions. This includes, without limitation, any inability to provide license verification or other Online Services.

18. GOVERNING LAW & DISPUTE RESOLUTION

a) This Agreement shall be governed by and construed in accordance with the laws of Belgium, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).

b) Any disputes arising out of or in connection with this Agreement shall first be attempted to be resolved through good-faith negotiation.

c) If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the courts of Antwerp, Belgium.

d) CONSUMER PROTECTION: Nothing in this Agreement shall limit any mandatory consumer protection rights that You may have under the laws of Your country of residence. If You are an EU consumer, You may bring proceedings in the courts of Your Member State of domicile.

19. ASSIGNMENT

a) You may not assign or transfer this Agreement or Your license without the prior written consent of the Author.

b) The Author may assign this Agreement to a successor entity (e.g., in the event of a company formation, merger, or acquisition) without Your consent, provided that the successor agrees to be bound by the terms of this Agreement.

20. MODIFICATION OF TERMS

a) The Author reserves the right to modify this Agreement at any time.

b) Material changes will be communicated through the Software (e.g., upon update installation) or via the email address associated with Your license.

c) Continued use of the Software after notification of changes constitutes acceptance of the modified terms.

d) If You do not agree to the modified terms, You may continue using the version You have under the original terms, but You will not be entitled to further updates.

22. EXPORT COMPLIANCE

You agree to comply with all applicable export and re-export control laws and regulations in connection with Your use of the Software.

23. SEVERABILITY

If any provision of this Agreement is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

24. WAIVER

The failure of the Author to enforce any provision of this Agreement shall not constitute a waiver of that provision or the right to enforce it at a later time.

25. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between You and the Author with respect to the Software and supersedes all prior or contemporaneous understandings, communications, or agreements, whether written or oral.
